Your Use of the BDS Website

Browser Compatibility
To view this website, we recommend you use a personal computer with a minimum screen size of 800 x 600 pixels and run any modern browser (such as Internet Explorer 6 or higher, Firefox Version 2 or higher, or Safari). You should have JavaScript enabled on your browser for best performance.

Intellectual Property Rights
This site is owned and operated by the FWEA Book Discussion Scheme. No material from this site may be reproduced, republished, uploaded, posted, transmitted, or distributed in any way, without prior written permission of the BDS, except that you may download one copy of the material on a single computer for your own, personal domestic use only, provided you keep intact all accompanying copyright and other propriety notices. Modification of any of the materials or use of any of the materials for any other purpose will be a violation of the BDS’s copyright and other intellectual property rights.

If you download any software from this site, including any files, images, code and data (collectively, the “Software”), the Software is licensed to you by the BDS. The BDS does not transfer title of the Software to you. You own the medium on which the Software is recorded, but the BDS retains full and complete titles to the Software, and all intellectual property rights therein. You may not redistribute, sell, decompile, reverse-engineer, disassemble or otherwise deal with the Software.

Restricted Use
You may not use any device, including any software or routine, which interferes with the normal operation of this site or take action that imposes an unreasonable load on the BDS’s servers or other computer equipment, or the computer equipment of the BDS’s internet service providers. You may not use any software, programmes, algorithm, methodology or other automatic device, including any spider, robot or otherwise, to monitor, copy, collect or harvest any data, information or content found on this site, or use any manual process for the same process.

Jurisdiction
Unless otherwise specified, the materials in the site are presented solely for the purpose of promoting the products and/or services of the BDS. This site is controlled and operated by MindMedia Group from its offices in Christchurch. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

Termination
This agreement is effective until terminated by either party. You may terminate this agreement at any time by destroying materials obtained from any and all BDS site(s), and all related documentation, and all copies and installations thereof, whether made under the terms of this agreement or otherwise. The BDS will terminate this agreement immediately without notice if, in the BDS’s sole discretion, you fail to comply with any of its terms and conditions. Upon termination, you must destroy all materials obtained from this site and any and all other BDS site(s) and all copies thereof, whether made under the terms of this agreement or otherwise.

Disclaimer
The BDS website is provided “as is” without any warranties relating to any subject matter, product or service accessed or obtained through the BDS website. The information available in all BDS publications, documents, and on the BDS website is intended to provide general and specific information to BDS members and the public, and all reasonable measures have been taken to ensure its quality and accuracy. However, the BDS may change, delete, add to or, otherwise, amend the information.

Limitation of Liability
Every effort has been made to ensure the accuracy of the information contained on the BDS website. To the extent permitted by law, the BDS shall have no liability to any person or entity with respect to any inaccuracy, misleading information, loss or damage caused directly or indirectly by the information contained on the BDS website. Changes and additions to information contained on the BDS website are made frequently, and the BDS may make such changes and additions to the website at any time without prior notice. Irrespective of any monitoring of content or other items on the BDS website, the FWEA BDS shall not be responsible for screening, editorial, or other control over content or other items and you acknowledge that such content may include material that could be deemed distasteful, misleading, inaccurate, offensive, pornographic or otherwise objectionable. There is no guarantee that the BDS website is, or will be, free of viruses or any other contaminating or destructive properties. You hereby release the BDS from any and all liability for all claims related to content, and any other items obtained on or through the BDS website, as well as to the security or level of privacy provided.

Responsibility for your Password and Login
To become a registered user in the Members’ Area, you must provide a password and a login name. You are entirely responsible for any and all activities that occur under your login name. You may change your password at any time by following instructions. You may also change your login by contacting customer service. You may also delete services attached to your registration at your convenience.

Copyright
Material featured in all the BDS publications and on the BDS website is subject to copyright protection, unless otherwise indicated, and may not be reproduced in any form without prior permission from the BDS. Any permission granted to reproduce BDS copyright-protected material does not extend to any material that is identified as being the copyright of a third party. Authorisation to reproduce such material must be obtained from the copyright holders concerned.

Governing Law and Invalidity
This agreement shall be governed by and construed in accordance with the laws of New Zealand, without giving effect to any principles of conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severed from this agreement and shall not affect the validity and enforceability of the remaining provisions. This is the entire agreement between the parties relating to the subject matter herein, and shall not be monitored except by an agreement in writing signed by the BDS.

Third-Party Offers
The site may include third-party material, advertising, promotions and/or links to third-party materials. Any dealings you have with a third party provider are solely between you and that third party. To the extent that the BDS assists you in your dealings with a third party, the BDS Is acting purely as an agent for the relevant third party. While the BDS has taken reasonable care to ensure that third parties are reputable, the BDS will not be responsible for the contents of any third-party material or promotion or be liable for any direct or indirect loss or damage suffered by you (or any other party) from accessing. The inclusion of any link or third-party material, advertising or promotion does not imply the BDS’s endorsement of or any association with the third party.

Indemnity
You agree to indemnify the FWEA BDS and its employees, distributors, agents and representative, and to hold them harmless from any and all claims and liabilities (including fees) which may arise from your submission, from your unauthorised use of material obtained through the BDS website, or from your breach of these rules, or from any such acts by any person using your login details. You further agree that the FWEA BDS is not responsible and shall have no liability to you, with respect to any material posted or supplied by others.

The BDS may offer links to other websites, and try to link only with sites that share our values. Nevertheless, we are not responsible for the content or information collection policies of other websites. If you visit another website, you should review their privacy and other policies.

Your Use of the BDS Website
You agree to use the BDS website only for lawful purposes. You also agree not to disrupt or interfere with the operation of the BDS Notice Board or Discussion Forum or other discussion or question-and-answer areas of the BDS website, nor to alter or tamper with any information or material on or associated with the BDS website.
